Step 1: The parties make a transfer contract at the Notary Office (or at the Commune People’s Committee). Documents to bring include: certificate of land use rights, copies of identity cards and household registration books of the parties.
Step 2: Carry out the procedures for declaring tax obligations at the People’s Committee of the district where the land is located.
Records include:
- Registration fee declaration (buyer).
- Personal income tax declaration (the seller, except for cases of tax exemption).
- Transfer contract.
- A copy of the certificate of land use right. (with endorsement)
- Copies of identity cards and household registration books of both parties. (with endorsement)
After the tax payment notice is issued: the two parties shall pay taxes within 10 days into the state budget.
Step 3: Carry out the procedure of declaring the name of the land use right:
Records include:
- An application for registration of fluctuations.
- Transfer contract.
- Certificate of land use right.
- Copy of identity card and household registration book of the buyer. (certified)
- Paper of payment to the state budget.
