The time limit for issuance of “House ownership certificate” must not exceed 15 days

From March 3, 2017, the time to carry out the registration procedures, grant “House ownership certificate”, “pink book” and ownership rights to other land-attached assets to the transferee has been shortened with a shorter period of time. Maximum term is 15 days.

This is the new content specified in Decree 01/2017 amending and supplementing a number of decrees detailing the implementation of the land law (Decree No. 43/2014, Decree No. 44/2014 and Decree No. 47/2014).

Specifically, Point 40 of Decree 01/2017 has amended the time for implementing a number of administrative procedures on land specified in Article 60, Decree 43/2014 as follows:

Registration and issuance of certificates of land use rights, ownership of houses and other land-attached assets (LURCs) upon change of land-attached assets; division of land parcels, consolidation of land plots, and procedures for land registration in the case of land allocation by the State for management is up to 15 days (previously this time limit was 30 days).

Registration and issuance of LURCs when changing assets attached to land is not more than 15 days (previously 20 days).

– Registration of changes in land and land-attached assets in cases of winning the auction of land use rights; settle disputes, complaints and denunciations about land; handling mortgage and capital contribution contracts with land use rights; distraint for auction of land use rights and land-attached assets for judgment enforcement; division, separation, consolidation, merger of organizations, transformation of companies; agreement on consolidation or division of land use rights and ownership of land-attached assets of households, husband and wife, groups of land users is not more than… 10 days (previously 15 days) .

Separation of land plots, consolidation of land plots; the land registration procedure for the case of land allocation by the State for management is no more than 15 days (previously 20 days).

– Extension of land use is no more than 07 days (previously 15 days)

And many other administrative procedures applied in Decree 01 have been shortened from 1/3 to 1/2 the implementation time compared to before.

Thus, according to Decree 01/2017, the time limit for granting a House ownership certificate to a land use right transferee must not exceed 15 days . This regulation has practical significance in helping people more convenient in carrying out administrative procedures on land in general and procedures for granting House ownership certificates when transferring land use rights in particular.
